No! It is not illegal if A Certified Garage will gives you the reason for the change like 'Motor changed' or if your original 'cluster' was not functional.
It is illegal if you sell your vehicle under the misimpression that the vehicle had done less mileage because of the replaced head and the seller does not inform the buyer of this change. A better way to deal with this situation is to get a written and signed by the buyer statement before parting with the vehicle!!

The speedometer itself will work but you will need to take the instrument cluster apart and transplant the speedometer unit from the 92 cluster into the 87 cluster. The speedo mechanism is the same but the clusters are different.

Not knowing the year, make and model vehicle it limits how much we can help you. If the speedometer cluster is digital and both the speedometer and odometer is not working I would suspect the vehicle speed sensor is at fault. If only the speedometer is not working I would suspect the dash cluster is at fault.
