it depends on the seriousness of the defect. A blown carburetor has to be,(not legally but if you want to sell it to anyone), replaced, a ding might be hamerd out but dosent have to be. A used car dealer can sell a car with almost any defect that is not a safety or emissions defect. They can sell the car with the engine missing if they disclose this to the buyer. Almost any used car will have some sort of defect. The criteria is that the car must be serviceable at the time, and all safety and emissions equipment must be in working order, unless otherwise stated. In other words it must do what a car does. Get you from point A to point B. Other than that all used cars are sold, "AS IS" unless otherwise stated in writing that there is a warranty. Get any car you plan on purchasing inspected by a trusted mechanic before you make the deal.

Yes and No. A dealer should not be able to sell a car without a catalytic converter. However, the dealer should assume that every car it purchases has a catalytic converter. Therefore, if the dealer was unaware, then the dealer has no liability in selling a car without a CAT. Ultimately, the liability lies in the individual whom removed the catalytic converter in the first place.
