It is illegal because it is a form of "Financial Fraud", a "misrepresentation" of the facts to the lender on an affied note. You would basically be lying to the lender to get the car. Acquiring it under false pretense. that's fraud.

Additionally by not listing the legal buyer / owner of the vehicle on the insurance policy you are exposing that person to all kinds of law suits and financial as well as legal liabilities. The titled owner can be held equally liable for any and all accidents, injuries, deaths etc, regardless of who was driving at the time of the accident.
