Not an answer: It would be very hard to calculate how many of people killed by drunk drivers were not drunk themselves, and it would take court convictions to determine if they were guilty or not. The date that is commonly available is Alcohol related deaths, and it is the 15,000 ballpark. It is not uncommon for intoxicated people to escape an accident uninjured due to a much more relaxed state upon collision, while the sober occupants sustain major injuries.

The Constitution never mentions a right of free choice. This is implied but not explicitly stated. The Constitution gives us the right to be secure in our homes and the right to freedom of speech (which today includes freedom of expression). There is no right to drink alcohol in the Constitution. Laws against drunk driving serve to protect the freedoms of the people who would likely be injured or killed by drunk drivers. Prior to strict drunk driving laws, nearly 60,000 Americans died on the roads every year, and 30 - 35,000 of them were related to drunk driving. Drunk driving laws protect the rights of the innocent victims. Constitutionally protected freedoms do not include the freedom to endanger others.
