Murdering a person who is working for the Devil is still murder and you will still stand trial for it. However, there are still some backward religions that do not understand the latest information about sexual orientation, and will still claim that it is a sin. It is not even a sin to pursue love if you are gay, because this is a primal need of all human beings.
I think it still counts a sin according to the rules of Islam. Intention of an action is more important than the action itself, but something is still a sin if a Muslim knows it is and does it anyway. BUT, something can only be counted as a sin if you know that it goes against the religion.
