Why is a penguin called a bird if it can't fly?

They have wings, a beak, and they have overall bird features such as warm-blood, a four-chambered heart, and a backbone. They don't fly because of their shape and size, so they are in the same class as ostrich and kiwi.

All birds have forelimbs modified as wings but only most - not all - can fly.
