As with all legal questions, you should seek the advice of a local attorney.
That said ... in most places the lender is required to give "reasonable notice" to the borrower that the repossessed car is to be sold, and generally "reasonable notice" is considerably more than "a few hours". It could definitely be worth your time to consult a lawyer, especially if the lender sold the car for less than you owed on it.
can my car be repo 38 day's in default?
the repo man come and repo my car the police made him bring the car back because he didn't have a signed consent from magistrate after going to magistrate will I have a chance to answer the dispository or will the car be repoed the same day
Nope,To clarify: provided that the other laws regarding repossession are complied with, the time of day is irrelevant. It might be more accurate to say that there is no ILLEGAL time of day to repo a car.
No
as a repossession
One day late. I live and own 2 repo companies in Washington. Sorry, but that is the law.
It is done in time not money i.e. days late.Generally 30-45 days late triggers a repo but they can repo after one day late.
As long as you are in DEFAULT of the contract, the lender can repo the collateral.
Read your contract. One day. As long as you are in default of the contract, the lender can repo the collateral. That could include no ins. coverage.
Any day is a good day but Saturday is the best day for an individual to sell a car. More people are off work and are out looking for a car on that day.
after 60 days they start the process. By day 75 it is repossessed
This depends on what state that you are in. Most states allow you to get a temporary pink slip that same day. If you are doing this to sell the vehicle they have forms where you do not need the pink slip and can still sell it legally and the new owner will get the title.
