The issue may be whether the vehicle being driven meets the definition of a CMV for regulatory purposes. The Federal Motor Carrier Safety Administration oversees the administration of Federal transportation laws. The definitions contained in 49 United States Code subsection 31301 cover both "motor vehicle" and "commercial motor vehicle". In order to be a CMV for regulatory purposes, a vehicle would first need to be a "motor vehicle". The definition of "motor vehicle", for the applicability purposes of this statute, does not include a vehicle which is not used on public streets, roads or highways. Therefore, federal regulations requiring CDLs may not apply to a truck-tractor operated exclusively on private property. In the case of a truck-tractor sometimes operated on public roads but not at the time it is under the control of a non-cdl driver, the distinction gets murky. In the case of a setting such as a commercial parking lot or truck terminal, great liability could attach for a non-cdl driver or employer in the case of an accident. Insurance policies would almost certainly exclude non-cdl drivers. There may also be state laws which restrict such activity in "public areas" even if they are on private property. No, you can not - it doesn't matter what state law says. The Federal Motor Carrier Safety Regulations states in no uncertain terms that you cannot legally be in actual physical control of any vehicle requiring a CDL to operate if you do not have at least the appropriate class of learner's permit for that vehicle. It doesn't matter if you're on public or private property. Companies and individuals which allow unlicenced persons to operate those vehicles are in violation of the FMCSR.
