You can tell by size behavior and markings size wise house mice will tend to be fatter with thinner fur deer mice will be smaller thinner and and fluffier behavior wise house mice will be used to humans and while still startled by you they will become used to your presence more quickly but deer mice will be terrified by you and will probably never get used to you without special care and expert advice marking wise deer mice will probably be brown and striped (camouflage) while house mice are usually grey brown or black

All deer are wild essentially and its not like a wild horse is a brumby, A wild deer is still a deer and what it is called depends on the species it is eg. Fallow/Red/Mule etc.

It depends on how you view it. If you view it as a wild animal taken from the wild, such as a deer mouse or a mouse found around the house, it would most likely cause extreme distress. However, domestic mice (fancy mice) cannot survive on their own due to their coat coloration and lack of wild instinct. It's more fair to keep them as pets than to release them into the wild where they wouldn't last more than a day or two, max. That would be considered cruel and unfair.
The mouse will almost certainly die, just hope you can find the body to dispose of it after death.
