The bash shell is open source. The Korn shell is proprietary and owned by David Korn of Bell labs (and the source is not available).

There is no "default" shell. Different distros are free to pick whatever shell they want. Many distros also use a variant of the Almquist shell provided by BusyBox in their initial ramdisks before switching to the real root and launching the main shell.
