I don't think you can, unless you have proof that a will/trust is not authentic. These kinds of arrangements wouldn't be worth much if benericiaries could be changed after death. They exist to insure that the deceased's intentions will be carried out.
Can an executor of will change beneficiaries before or after death
No.
The beneficiary has not control over the will. The court will determine who the executor will be.
The policy holder has the choice to change the name of the beneficiary at any time, including after the death of a named beneficiary. If the policy holder doesn't change the name of the beneficiary after the beneficiaries death, depending on what state you live in it goes to next of kin.
Perhaps this question could be rephrased. The answer to the question as posed is: after the death of the insured, the policy becomes void, and the benefits payable. The simple answer is no, you as the owner can not change the beneficiary after the death of the insured (subject of insurance).
No. The contingency that triggers payment of a life insurance is the death of the named insured. That person could have changed the beneficiary designation prior to his/her death. Even if the policy had given the power to change the beneficiary to another person, the change would have had to be exercised before the named insured dies.
As long as you did not make your beneficiary irrevocable, you can just change your beneficiary. If your beneficiary is irrevocable you are out of luck unless you can get them to authorize the change.
This would be very tricky and probably involve legal issues. A "new form" found after death changing beneficiary would always bring about suspicions. Did the owner intend to change the policy or not? They did not complete the transaction by filing the change with the insurance carrier. It is my opinion that the court would rule in favor of the beneficiary currently listed on the policy at the time of death. You could never prove the intent of the policy owner to change the beneficiary if they did not file the change of beneficiary form which is a very easy process to do.
The beneficiary is the person to receive the coverage amount when the person covered by the policy dies. In the first instance, the beneficiary is named by the applicant when application for the insurance policy is made. Unless the beneficiary designation is made irrevocable, the insured is free to change the beneficiary at any time until his/her death. Unless some provision of law or contract renders the designation of beneficiary irrevocable, the beneficiary does not have a right to remain as beneficiary and ordinarily cannot contest a subsequent change.
NO. The beneficiary is only entitled to the death benefit proceeds when the insured dies. The owner of the life insurance policy controls the policy, the beneficiaries, any cash values, and is responsible for premium payments. The owner has the ultimate control of the life insurance policy and can change the beneficiary of the policy at any time...and does not need the beneficiary's permission to do this. The Insured can change the beneficiary on a life insurance contract.
