You do not have many choices. If your teacher sees your phone while you are taking a test, the teacher is probably going to assume you are cheating. If you are cheating, simply take whatever consequences your teacher has for it. You could try to talk your way out of it, but it would probably make the situation worse for you. If you truly were not cheating, then you could attempt to explain that to your teacher, but there would most likely be some consequences for having your phone out at all, especially during a test.

That will vary. The bigger question is, why would a kid have a cell phone at school? Not being picky, but it makes a difference. If it's against the rules, then the teacher could probably at least take it. If not, then I don't think he should have.

Oh, that's an easy one. If you can get into the classroom before the teacher, and if they're classroom phone is hollow, find a way to open it up. Every day, put a single nickel (or any small object with some weight) inside the phone. After several days of doing this, once the teacher has gotten used to the weight, take them all out. The teacher will probably hit themselves in the face or send the phone flying across the room. :D

It depends on your teacher. My teacher use to say: If i hear it , see it, I take it. And she would give it to the office. But, other teachers give you a warning the first time and then if it rings the second time they will give it to the office. But, if they catch you texting, they will directly give it to the office. If your phone goes off, try to shut it. But, if the teacher asks who's phone, you should be honest because they will find out anyways. But if you shut it before they ask, then stay quiet and do NOT look suspicious.
