It depends on where you are asking about. Under normal conditions, either a state or federal agency decides the issue and makes the rule, or law or whatever.
However, in California, in a 1990 initiative, the voters decided to prohibit the sport hunting of mountain lions. They successfully ended the ability of the state to use hunting to control animal population for the benefit of both humans and the cat population. Now the mountain lion in California is encroaching on populated areas, killing pets to survive and increasing the incidents of negative human contact and the government is limited in it's ability to protect either it's citizens or the cats.
It's unfortunate that a vocal few can force the end of one of the few animal population control tools available to biologists.
