The spin cycle of the washing machine is the cycle during which the water is drained from the machine. It has to go somewhere, and it sounds as though the outgoing water is going out the same exit as the water from your kitchen drain. If it is just gurgling, that would be the water traveling out. If it is a "horrible" draining sound (minus water leakage somewhere), there may be an obstruction in the pipe just below your kitchen drain, or maybe your diverter is malfunctioning.

Get a licensed plumber in there to take the u-pipe off, and to look and see what's going on. An obstruction or a malfunctioning diverter would be a problem, but this doesn't mean it isn't up to code. The contractor doesn't want to look into this, so he is hoping that you will leave him alone by saying it's up to code. He is dodging responsibility. This is like buying a new TV, and when you get it home, it doesn't work. You call the store, and the salesman says, "Well, it is supposed to work. It says so on the box." If the fact is that it doesn't, there is a problem, period. That TV is probably "to code," but it doesn't work. Therefore it is a problem that should be addressed.

He could be a nice guy and send his plumber out to see what's going on. If you still owe the guy any money, refuse to pay another penny until he addresses this problem.

From experience here: As soon as you pay in full, the contractor washes his hands of you. DO NOT pay the balance until every item on the punch list is completed. If you do, his punch list becomes your punch list.

this guy doesnt know what he's talking about...your washer is probably on the main floor and probably drains into the same line as your kitchen sink....and it's probably not vented...and it needs to pull air to drain....so it pulls the water out of your kitchen sink trap...get a plumber to install a vent on your washer drain line...or cut in an air admittance valve (cheater vent)
