An aircraft maintenance discrepancy is not specifically defined as a term in the regulations. While the definition of maintenance is found in Title 14 CFR Part 1 as Maintenance means inspection, overhaul, repair, preservation, and the replacement of parts, but excludes preventive maintenance. The National Transportation Board (NTSB) has used definitions from standard dictionaries in case law. for example, Merriam-Webster's Collegiate dictionary defines the word discrepancy as the quality or state of disagreeing or being at variance. So when we look at a variance it's a comparison to a standard. Here's where the word airworthy defines that standard and although not defined is not in the regulations, FAA guidance material defines it as "meeting it's type design data and safe for flight" So there is some room for the degree of variance when you consider normal wear and tear. When that variance of wear and tear exceed the limitations defined in the type design data the airframe, engine, propeller or component is no longer airworthy.
