It depends largely on the relationship you have with that person. If they are a family member or someone who has established residence there, you have to go through the local court's eviction process. If this person is generally a transient person, meaning a guest for a few days, and not someone who lives there, you can tell them to leave and if they refuse they can be arrested. In some states, the Police may require you to file charges yourself, but generally you can give the order in front of the Police and if the person refuses to leave an arrest will take place. If the individual is a roommate on a lease etc, they will have to be evicted through the courts.
