Yes. If he is not on the lease he has no legal right to be there. One exception, in some states, if you have presented yourselves as husband and wife, that is enough to be considered common law married. In that case, I would think he would have more rights and possibly could stay.

Also, in some states, if the person has been living there more than 2-weeks or receiving mail there, you may be required to give them like 30 days notice!
