I think it can be if you sleep around with others and do not tell them you have it. It would depend on the circumstances and the laws of the state that you live in. I once saw a case where a man had knowingly given herpes to several women. He never told them he had it. Each of them filed a lawsuit against him. I think what made a lawsuit possible is the fact that he KNEW he had it. I guess if someone somehow didn't know they had it, it would be different. I'm not a lawyer so I don't know that for sure.
