40 Year Olds can indeed date 18 Year Olds, despite the age gap. Generally, such age differences are seen as 'unpleasant', but the Law only has issues when someone of 18 Years and Over dates someone younger than 18. This is because if an 18 Year Old (someone considered an Adult in UK society) dates someone under this age, it can be classed as Paedophilia. Because someone of 18 Years of age is an Adult, just like the 40 Year Old, it is left at the 18 Year Old's discretion as to whether they date this person, as they are legally viable to make their own decisions and look after themselves in wider society. ADDED: Same applies in the U.S.
