Tom Robinson was originally in jail because he had been accused of raping Myella Ewell obviously if a man has been accused of this (racism of not) he will be on a probation , in those days due to the accusation by putting him in jail the law felt this was the correct decision as this way he could not be harmed by any members of the public without protection.
