It is called Forgery. You are not supposed cash checks that belong to someone else. The affected party (The person whose check you cashed) can sue you legally and you can be jailed for committing this forgery. In short, you'll end up behind bars if you happen to do this.

I just found out the hard way that you can no longer have your tax return deposited into someone else's account. I filed my taxes and both my daughter's taxes at the same time. Both of theirs were deposited into my youngest daughter's account, mine was supposed to be deposited into that same account but was sent back to the IRS to be mailed as a paper check. I called the bank and spoke to a representative there. She said the IRS will no longer let people direct deposit into someone else's account. I'm guessing because my daughters names are similar is the reason they both made it through, but I have a different last name. Anyway, FYI . . . . .

No. you cannot do that. A check can be deposited only into the account of the person to whom the check is issued as payee. If you try to do this, it will be considered an illegal activity and you can be jailed for forgery. However, if you have a power of attorney from the other person to whom the check is issued, then you can do it. A check is a negotiable instrument. You obviously cannot just take it from who was to receive it and deposit it. That is criminal. However, the person/company to who it was made out may endorse it (either fully opne so anyone can do with it what they want) or specifically (as in too someone or place), and then it can be further negotiated. That is frequently calleda 3rd party check....and it is not uncommon that a check will end up with many endorsements (and be a many party check) as it moves through the banking system.
