Basically drinking ONE drink is considered in violation of DUI laws. they aren't looking for drunk drivers, they are looking for a driver who has drank any amount of alcohol. (.08 is NOT drunk) Never ever admite to drinking alcohol to a cop. If you do, the automatic and required next step for them to perform is a sobriety test (which you can legally decline to do) and breathilizer test (which you legally can NOT decline to do). So you are screwed right then if you've had even one drink.
