Technically no they aren't covered. However the main problem that we have is that NO WHERE in policy does it say that they are noncovered. What I would suggest doing is just have the beneficiary fill out an ABN and you can bill it through as E1399 with a GA modifier, showing an ABN is on file. That is really up to you because you are essentially billing a non covered code. However, there are instances where you can use that code with a narrative and maybe even get a paid claim.
