In the 2nd Harry Potter book Percy takes house points away from Ron but in the 5th book Hermione tells Draco prefects can't take away points which is correct?

Prefects are allowed to take points but not from each other.
Percy could take points from Ron because Ron wasn't a prefect at the time. Hermione told Draco he couldn't take points from her and Ron because they were prefects but Draco was a member of the Inquisitorial Squad and so could.
