He never died, in certain versions he had a son and he took over his career in bat-man beyond. That is when he dies (apparently) but if your according to present day DC comics then he hasn't died. If they did it would totally kill the justice league along with the rest of the DC universe. Marvel would then be the ultimate comic series.
