I would believe so yes. You can't get herpes from wearing someones clean underwear. Unless they have it and it wasn't washed properly :)
You shouldn't share underwear with anyone, that's not right, but if you must, then I'd say watch yourself. If you wash them first then you most likely cannot become infected with herpes because it needs a host cell to live within and it dies within a few minutes of leaving the body. It can't live on clothing. But just to be safe, don't share underwear!
