According to UNSC Resolution 242, Israel was required to cede the West Bank back to Jordan in order to have a peace treaty. As a result, when the Israeli Prime Minister Yitzhak Rabin was negotiating with Jordanian King Hussein bin Talal of Jordan, Rabin offered to discuss a phased withdrawal of Israeli control from the West Bank and its restoration to Jordanian power (similar to the Sinai Peninsula phased withdrawal). King Hussein actually rejected this overture arguing that they wanted to cede their claim to the West Bank to the Palestinian Authority. Israel agreed to transfer the claim to the West Bank to the Palestinian Authority and made peace with Jordan in 1994.

Israel has negotiated on and off with the Palestinian Authority concerning phased withdrawals and areas of local governance. However, Israel has never offered the Palestinian Authority all of the West Bank. (Israeli Prime Minister Ehud Barak offered Arafat roughly 95% of the territory in 2000, but this was rebuffed because Israel refused to approve a Palestinian Right of Return to Israel.)

Where is Israel under Palestine's control?

Yes, Palestine was a country. When Israel was created in 1948, the land was occupied by the British and before that the Turkish Empire. When the UN created Israel after the Holocaust they wanted to split the land in half. Half as Palestine and half as Israel. Arabs did not like the idea. As the British retreated from Israel all the neighboring Arab countries tried to take over Israel. A war ensued and as the Jewish people pushed back their Arab neighbors they declared the land Israel. Palestinians today who live in the West Bank were Jordanian before the war, but never went back to live Jordan, because they want to stay in their home country. The West Bank and Gaza both are Palestinian and are still in Israel, but are run by their own Palestinian governments. Palestinians are determined to get THEIR land back.___________________________________________________________ Palestine has been semi-autonomous (the Palestinian Authority) since renouncing war on Israel in the 1990's. As stated above, the Palestinians in the West Bank and Gaza now govern themselves, but they are not an independent country. They are still technically part of Israel. A study of history will show that this land has had many rulers before the Israelis, the Brits, and the Turks. But as the Arabs say"our land will be back".

Why should Israel remove or keep its settlements from the west bank?

Israel should not remove anything. West bank is the name Jordans used for the part of the territory of israel called Judea and Samaria that were occupied by Jordan. Following the Second World War, The UN passed the United N general Assembly Resolution 181, which aimed to establish two states within Mandate Palestine: one Jewish and another Arab8 there was not any mention about any "palestinian "State, as there was not any "palestinians" at that time. The Resolution did not contain any reference to any West bank but clearly pointed to hte territory described as "the hill country of Samaria and Judea". This territory is the heartland of the Jews and include the capital of the Jewish State: Jerusalem. following the 1948 Arab-israeli war in which five Arab states, Jordan among them, attacked the recently created Israel, this area was captured by Transjordan (renamed Jordan in 1949). "West Bank" or "Cisjordan" became the name for the area west of the Jordan River, as "East Bank" or "Transjordan" designated the area east of the river. The interim boundary between Israel and Jordan's West Bank was defined in the 1949 Armistice Agreements, and Jordan ruled over this territory from 1948 until 1967, annexing it in 1950. In 20 years, Jordan did not move a finger to create there any "Palestinian State", and Arabs who lived there did not show any sign of discontent about this. In June 1967, Judea, Samaria and Jerusalem were liberated by Israel from the Jordanian occupation after the Arab- Israel Six-Day War. With the exception of East Jerusalem and the former Israeli-Jordanian no man's land, the West Bank was not annexed by Israel but has remained under Israeli military control and got back its historical name: Judea and Samaria. Since the 1993 Oslo Accords , parts of Judea and Samaria passed under full or partial control of the Palestinian Authority. Though 164 nations refer to the West Bank, including East Jerusalem, as " Occupied Palestinian territory" the State of Israel logically insists that only territories captured in war from "an established and recognized sovereign" should be considered occupied territories, and as Jordan renounced of any claim on Judea, Samaria and Jerusalem after signing the Peace treaty with Israel in 1991, this territory is legally the territory of Israel, and only Israel has the right to decide, what to do with it. Besides, in 2006 Israel in a unilateral move withdrew from Gaza, which makes any talks about "occupation" absolutely senseless; there is not a single Israeli, military or civilian, in Gaza where the power was seized by the terrorist group called Hamas.

Does Israel own the West Bank?

Answer 1The West Bank is a part of the state of Palestine, although the entire state of Palestine has been under Israeli occupation since 1967.Commentary on Answer 1The West Bank was annexed by the Kingdom of Jordan in the 1950s, although the residents of the area were never accorded citizenship in the Kingdom, and the territory itself was by and large not integrated into the country's economy or society. It's a rather awkward reality that more than 50 years after its annexation by the Hashemite Kingdom, large communities of Muslim Arabs still live without Jordanian Passports in areas still described as 'refugee camps'.As of the beginning of 2013, the West Bank is governed and policed by the Palestinian Authority (president Mahmoud Abbas etc.), and travel between the territory and Israel is tightly controlled by Israel at their mutual border, for obvious security reasons. There is little if any cooperation between the Palestinian communities of the West Bank and the Gaza Strip, understandable since Hamas took over Gaza in an armed campaign and overthrew the Palestinian Authority in 2007 (after the withdrawal of all Israeli settlers and military personnel.)The West Bank will undoubtedly comprise a major portion of a Palestinian state when one is established, but that hasn't yet taken place.Answer 2As concerns ownership of the West Bank, Jordan attacked Israel first and Israel retaliated. Since Jordan attacked first, Israel conquered the territories in self-defense. Since actions in self-defense are considered legally justifiable, Israel would have the rights to those territories. However, Israel was willing to concede some of those rights pursuant to a final, lasting peace with its Jordan. Therefore, Israel ceded the possible claim to the West Bank to Jordan in UN Resolution 242 and Jordan then agreed to cede its rights to claim the land in full to the Palestinian Authority in 1988 and 1994. Because of this, the Palestinian Authority has the right to claim the lands of the West Bank. There are certainly Israelis who disagree with the extent of these rights, their viability vis à vis their religion, or use the doctrine of terra nullius to disavow the Palestinian Authority of these rights, but this is the minority of Israelis. Most Israelis want the majority of the West Bank to revert to the Palestinian Authority with a guarantee of peaceful coexistence. Since the initial Israeli cession to Jordan in UN Resolution 242 required a final peace treaty for the transfer of territory, that final peace is requisite for the proper transfer of the land.
