Closed shop states are those where employers are required to hire only union members and maintain a workforce comprised exclusively of union members. As of now, closed shops are illegal under federal law due to the Taft-Hartley Act of 1947, but some states have laws that allow union security agreements, such as union shops or agency shops. It's important to note that the legal landscape may change, so checking current state laws is advisable for the most accurate information.

According to Webster, the term Open Shop appeared in 1903. It pertains to a place of business in which it is not part of the contract that a worker has to join a union. In fact, in most Open Shops, there are few workers who join unions but the owner may allow a union to hold an election of the employees and if they agree, a union may represent the workers in negotiation with management. Open Shop is different from a Closed Shop. In a closed job, any person wishing to work in that business establishment must either be a member of the Union or join the union once employeed.
