The Jim Crow Law Era existed mainly in the South and originated from the Black Codes that were enforced from 1865 to 1866 and from prewar segregation on railroad cars in northern cities.

By most accounts, there was no one place they began. Rather, they emerged state by state throughout the south, beginning in the early to-mid-1870s, as a reaction to black men getting the right to vote. Some Jim Crow laws were passed by local state governments; for example, in the period from 1870-1873, the government of Tennessee passed laws restricting where black students could go to school and mandating separate schools for white and black students. Alabama's legislature passed a similar law in 1875, also mandating separate schools for black and white students. There were additional laws passed in southern states during this period of time, restricting where black people could live or work, which hotels they could stay at, etc. Gradually, the few freedoms black people had enjoyed during Reconstruction were taken away. By the late 1880s, these laws had become the norm in the south, as white supremacists in state legislatures attempted to legalize segregationist policies.

One notable example occurred in Louisiana in 1890: the state's General Assembly passed a law that prevented black passengers from riding on railroads in the same cars as white passengers-- and even though the Louisiana legislature still had sixteen black members, they were badly outnumbered. This particular law ultimately reached the Supreme Court, and as the 1896 case "Plessy vs. Ferguson, " it legalized segregation, under the guise of "separate but equal," throughout the US.
