Principle of Division of Powers
The principle of limited government, which is the idea that the power of government should be restricted by law and that individuals have certain rights that cannot be violated, was based on the Magna Carta in the colonies. The Magna Carta established the concept that even kings and rulers were subject to the law, and this principle was carried over into the representative governments in the colonies.
Jefferson Davis
The authors of the Declaration of Independence believed that British policies violated the ideals of representative government because the colonists were subjected to taxation and laws imposed by a distant Parliament in which they had no direct representation. They argued that legitimate government derives its authority from the consent of the governed, and the lack of representation undermined this principle. Additionally, the imposition of arbitrary laws and restrictions by the British crown was seen as a violation of the colonists' rights and liberties, further justifying their quest for independence.
Right to constitutional remedies is itself is a Fundamental Right. This right makes other rights effective. It is possible that sometimes our rights may be violated by fellow citizens, private bodies or by the government. When any of our rights are violated we can seek remedy through courts. If it is a Fundamental Right we can directly approach the Supreme Court or the High Court of a state. That is why Dr. Ambedkar called the Right to Constitutional Remedies, 'the heart and soul' of our Constitution.
