As of November 2011 they seem to be as they are openly advertised. However, the fact that they are free floating fire carriers I question how long this will remain so. Not only because of the fire risk to fields, and woodlands in dry conditions but also the fact that (according to the advertising) they rise a mile or more in the air and would seem to pose a possible hazard to air traffic. Simply because of these two facts I question their continued legality for sale.
Chinese lanterns are typically made of paper or silk, which can catch fire easily. It is not safe to light Chinese lanterns indoors or in windy conditions as they can cause a fire hazard. It is recommended to light Chinese lanterns outdoors in a controlled environment to ensure safety.
Not really. In most parts of Texas, sky lanterns are considered a fire hazard and are illegal to use. Because they float away while still lit, they can easily start fires — especially during dry seasons. Many counties and cities across Texas follow strict fire codes that don’t allow them. Planning a wedding or event? Don’t worry — there are safer (and just as beautiful) alternatives. One of the most popular choices these days is wedding sparklers. They’re legal in most areas, easy to use, and look amazing in photos. At Wedding Day Sparklers, offer top-quality sparklers for weddings that can help make your send-off magical — without the risk. Just make sure to double-check with your venue to be sure sparklers are allowed. So, while sky lanterns are out in Texas, there are still plenty of ways to light up your big day — safely and beautifully.
As of my last knowledge update, sky lanterns are illegal in San Diego due to fire safety concerns. The use of these lanterns can pose a risk of wildfires and other hazards. It's important to check local regulations or ordinances for any updates or changes regarding their legality. Always prioritize safety and local laws when considering the use of such items.

Sky lanterns are not legal in Utah or any other state that has adopted the International Fire Code (IFC). While not specifically identifying sky lanterns the definition of a recreational fire would fit what a sky lantern is. The IFC states that all Recreational Fires must be attended by a person at all times until they are completely extinguished.Since a sky lantern is allowed to float away as the air inside the lantern rises in temperature, the flame inside the sky lantern cannot be constantly attended by a person until it is extinguished. The sky lantern is free to float to where ever the air currents take it.The bad part of it is that it may become caught in a tree or on a house or other object and spread it's fire to what ever it gets caught in. This could be a tragic event caused by something that seemed so harmless. Whoever lit the sky lantern would be held responsible for damages caused by their sky lantern.
Flying lanterns also know as sky lanterns are airborne paper lanterns are constructed by bamboo and oiled rice paper. At the bottom is a little light, once lit the lantern will go up
It is not recommended to create a fuel cell for a sky lantern as it can be dangerous. Commercially available sky lanterns are designed with safe fuel cells that should be used as intended. It is important to follow the manufacturer's instructions to ensure the safe use of sky lanterns.
