For a licensee, when engaged in waiting on or serving customers, to consume spirituous liquor or for a licensee or on-duty employee to be on or about the licensed premises while in an intoxicated or disorderly condition. In manys states a bartender or server cannot drink alcohol while on duty. Most establishments set their own regulations and most do not allow employees to drink while working due to liability issues.

Section 493 of the Liquor Code prohibits the consumption of liquor or malt or brewed beverages while tending bar or otherwise serving liquor or malt or brewed beverages. [47 P.S. § 4-493(28)(emphasis added)]. The term "service" is defined by the Liquor Code as "the act of providing…alcohol or malt beverages to a patron." [47 P.S. § 1-102]. Accordingly, so long as the officer or employee that is drinking is not engaged in the service of patrons, neither the Liquor Code nor the Board's Regulations prevent that employee from going behind the bar to perform other tasks.
