Under the OSHAct, employees have the right to a safe workplace, to receive information about hazardous chemicals, to report workplace injuries or safety violations without fear of retaliation, and to request OSHA inspections. However, one right that is not included under the OSHAct is the right to refuse work that is deemed unsafe without following specific procedures, such as notifying the employer and allowing them to address the safety issue.
Employee rights under the Occupational Safety and Health Act (OSHA) include the right to a safe and healthy workplace, the right to receive information and training about workplace hazards, the right to participate in safety activities, and the right to report workplace hazards to OSHA without fear of retaliation. Employees also have the right to access their medical records related to workplace exposure and the right to request an OSHA inspection if they believe there are unsafe or unhealthy conditions at their workplace.
Employers have a right to informal conferences with OSHA following an inspection, to contest citations and to appeal to the federal court system. They have a right to comment on proposed regulations before they are issued. In broader terms , they have a right to see the OSHAct implemented in a neutral, objective fashion, following the Administrative Procedures Act.
