As far as marriage is concerned: You have to be at least 18 to marry without parental consent. With parental consent, parties can marry at age sixteen and parties under the age of sixteen can receive a license by reason of pregnancy or the birth of a child.

As far as the 22-yr-old boyfriend is concerned: The age of consent (the age at which a person may consent to sexual contact with ANY person NOT in a position of authority) in Florida is 18.

However, if a person is less than 24 years old, they may enter into consensual sexual contact with a person who is at least 16 years old. There is also an "age difference" provision in the law for an age difference of 4 years - so 12 & 16, 13 & 17, 14&18, 15&19, can skate by. Obviously for 16 vs 22, that provision would not apply. The state law kind of breaks it down into whether the younger person is under 12, 12-15, 16-17 and 18+.

Under 12 = prison.

12-15 = prison if more than 5 yrs difference in age,

16-17 = prison if older person is more than 24, no prison if married or older person 24 or less.

18 and older = no law against it as long as both parties are consenting

NOTE: If the guy got the girl pregnant before she turned 16, the 22-yr-old can still go to prison and be registered as a sex offender.

Best thing to do is get some legal advice if you want to get married.

In your case, due to the fact that your boyfriend is several years older than you, he could face jail or even prison time, because he got you pregnant before you turned 18 years of age ----- HOWEVER, unless you are okay with having your first child when you are 16 years old and if you don't care about how old he is then, "NO" he can go to jail / prison
