According to the law, the age of consent in Florida is age 18.

Close in age relationships is however not punishable. A person 24 years of age or older who engages in sexual activity with a person 16 or 17 years of age commits a felony of the second degree, punishable as provided in s. 775.082, s. 775.083, or s. 775.084. As used in this section, "sexual activity" means oral, anal, or vaginal penetration by, or union with, the sexual organ of another; however, sexual activity does not include an act done for a bona fide medical purpose.

As of being age 18, you will be considered close enough in age.

From this I do not think any prosecutors would have a case.

We all know the "risk" of having sex. Even a 16 year old girl.

I can not see that the law would "allow" you to have sex with her but punish you if she get pregnant by it.

If you by any chance forced her to have sex with you, then you stand serious charges.

Sex is illegal when the minor is too young to give consent so this would depend on where you live and the age of consent there. In California for instance the age of consent is 18 with no close in age exemptions so there you would go to prison.
