It depends on where you are and who the judge is. In some states they will listen to the children and take that into consideration if the judge feels the child is old enough to decide. In Some states it does not matter some judges will try to push for the relationship anyway.

Depends on what is concidered "filthy". If the DHS would concider it to be unlivable you can talk to the father letting him know its not an acceptable living condition for the child. that it teaches the child to be filthy. If worse comes to sorse you can contact the state and report it.
