Can a divorced parent take children out of the United States without other parent's permission?

The court order may (and probably does) specify the visitation privileges of the parent (former spouse). If emigrating violates this order, no, you may not do it without the permission of the former spouse and the court.

It depends on the custody agreement you have with your ex. He has a right to see and be with his kids. Before you make any plans, you should discuss this with your ex to see if there is a way he will agree to the move. Perhaps it will mean summers at home with dad. If you have a strong reason for wanting to make this move but your ex will not cooperate, you may have to go back to court and try to change the custody agreement. Your ex has rights in this that have to be considered. Your children also have rights. They need a dad and a mom. (sorry for assuming it is the mother who is moving) It is wrong for you to deny them access to their dad and that might mean that you delay your plans until the kids are older or out of school. Keep the best interest of your kids as your priority. They didn't divorce the guy, you did.

Not legally no. It's always best to have either the other parent's notarized permission or better, that of the court to avoid some (potentially) very nasty felony charges.
