If you put it on your application that you where in custody then they can ask you why. It is your own discretion to answer them honestly or with a false answer though. The truth is the best and will be held with higher standings then lieing to them.
That kind of thing is very embarrassing to the employer. The consequences depend on the severity of the wrongdoing. If you are talking about criminal wrongdoing, the employer could go to jail. Lesser offenses might harm the public relations of the business even if the employer does not go to jail. In such cases, the employee must expect that the employer will not be happy to have his or her wrongdoing publicly exposed. Continued employment at that business would be in doubt (although if the job is in the civil service, or is unionized, special circumstances apply).
Former employers can only inform present or future employees of the salary that was being paid, title, job description, and duration of employment. Any other information that you share may be grounds for a law suit. I would say, just be glad that employee is someone elses problem now. The previous answer is just groundless. An employer can say anything factual about a former employee, with no liability for defamation: "We fired Pat after an investigation", "Pat failed the apprentice exam", "Pat had three unexcused absences the last week here", "Pat was in jail for a week and missed work". You can PAY a lawyer to sue the employer for giving valid facts about you from its files. Every court will dismiss the case; it is not defamation to report the facts to someone with a need to know (the prospective employer).

No...the employer...both corporate and personally is responsible. This is a criminal and fraudulent act that will be pursued by tax and legal authorities vigorously. The penalties are sever and jail time is common. The employer is stealing US Government trust funds....a very bad thing.
