yes they can. you can in turn press charges on them as well, take it to court and state your claim, and hope you get a good judge. but more then likely, the other person will bow out if they know you are going to press charges, and they were in the wrong.

If someone hits you and you don't strike back, they're probably not going to hit you again. If that's the case, you should then try to work out your issue in a more civilized way. Technically you could press charges, but then again you could also still press charges even if you hit them back in a situation where it is necessary to exercise self defense. Never instigate or provoke a fight.

Basically just avoid physical conflict because nobody ever wins in a situation like that. If anyone ends up pressing charges, you're all going to spend a lot of time in court for something that's almost certainly not worth it.
