No, sadly enough the State of Virgina will not permit such an act because neither of the two partners is of a legal, consenting age. In other words the stae will consider them to be children. However if a crime is committed of great offense, then the 16 year olds can be tried as an adult to the maximum punishment. Isn't the law fickle?
