Yes he can. He was on your property and your dog bit him. However it is unlikely he will sue a very large majority of civil cases are settled out of court either through mediation or negotiation.

Yes you can but you would have to have evidence of it. But I suggest you do not sue them because you wouldn't gain anything, and their dog would be euthanized and that is awful.
