If you have been kept back because you are not doing well at your current grade level, and you are not prepared for the next grade, then the school is just doing its job and cannot be sued for that (if you did sue, it would be considered a frivolous lawsuit). However, if you are actually doing well, but the school administration has some desire to interfere with your education (hypothetically, let us say that you are a member of an ethnic group that they don't like) then you would definitely have the basis for a lawsuit. Only for that reason you can sue the school.
