Yes. Between me and you I'll have someone after her ass!
You are obligated to pay child support unless you have a court order stating otherwise. If the child's last name was changed due to a step parent adoption/termination of parental rights then you need to go to court to have child support payments ended.
The only way to have your child's last name changed to the name of your new husband is for him to legally adopt her through the family court in your county.
Actually, there is nothing in a name. You can change your child's name to your favorite actor's last name if you like. Relinquishing child support from the father would only take place if your new husband got permission from both you and the child's father to legally adopt your child. This would in turn mean that your ex-husband is not legally your child's father any more. Which can cause other issues. For example, in the event of your ex-husband's death, your child would not be eligible for SSI benefits because the child is not legally his anymore.
If you are shown to be the biological father of the child, you may be liable for child support under the laws in some states. Only a qualified lawyer in your own state can advise you how to proceed.
Your ex-spouse can only change your child's last name if they have sole custody. If that is not true, then you should talk to a lawyer about getting an injunction.
if a judge agrees
If you live in the US, the fact that he changed his name is irrelevant. Since you adopted him, you are the legal father and as such are responsible for child support for as long as the court has ordered.
If you are still married, then telling the husband is the best thing to do, since it will come out in the end. The name of the child is the least of the problem--just do what makes sense in the long run for the child.
Personally i would keep the child's last name or hyphenate it
yes you still have to pay child support expecially the child is yours unless u want 2 go to jail i kno because my big brither have 2 pay child support and the baby momma change iits last nameand he almost went 2 jail if he didnt pay 1,100 dollars.
== == If your baby is unborn you may name the child any name you'd like, including the last name. You can give the child it's father's last name and not your husband's. However, in most states if you are legally married you must put your husband's name down as the father. You can get it changed by getting a paternity test done. I would recommend getting legally divorced to simplify matters. ~Michelle == == If your ex has not helped support your child and is not in your life then yes you can have your husband (but not a boyfriend) give your child his last name, but it must be done through a lawyer. Your husband would have to actually adopt your child. If your ex has supported his child through the years, then you must seek permission from him and hopefully he will peacefully allow you and your new husband the right to go to a lawyer and change the name. Even if the biological father disagrees there are some loop holes the lawyer can find to do as you wish. Good luck Marcy
Child support has nothing to do with the child's name. Just because you pay support, the mother is not obligated to give the child your last name. Many people feel that the child will be more comfortable having the same last name as the custodial parent.
