Yes, in most schools, the teacher has the right--and responsibility-- to confiscate items that are banned or that a student has out during class and refuses to put away when asked. If you are not paying attention (ie. texting), you are interfering with your schooling, which has been a hard won right given to people. In many countries, people would be surprised that you were allowed to stay in class, as well. Most teachers will return the items, or send them to the school office for storage. Get over yourself and do appropriate learning activities in your class.
