Bankrupt and still having troubles with the basics... (like you may not be in default of your C 13 payment agreement (and not being in default isn't something to be rewarded...it is expected) ...but by being in BK you are clearly in default of many agreements you have made on what you would do...YES, YOU ARE IN DEFAULT to many people who relied on you paying differently than you are...and that they still likely won't get all of what you promised they would.)

When you made a debt you promised/swore/contracted/begged to be allowed..... to pay it using money you would get and give over.

You promised this money to pay your debts.

This money isn't really yours since you committed/promised it to someone already.

Keeping it in spite of the similar promises and directions to pay it over to the court is criminal. Generally fraud.

(You want to pay your debts and make good on your promises, don't you?)

Why can a trustee take your income tax return if you are filing a chapter 7 bankruptcy which relieves you of your debt and does the trustee give the money to the creditors?

The trustee may take the refund and distribute it to creditors because a tax refund is not considered an exempted asset under bankruptcy laws.

If you file a bankruptcy 7 in August what happens with your tax refund that you may be entitled to the next year and thereafter?

If the debtor is entitled to receive an income tax refund or a similar nonexempt asset in the near future, he or she should not file under chapter 7 until after the refund or asset has been received and disposed of. Otherwise, the refund or asset will become the property of the trustee.

Do you have to file a federal income tax return if you only made less than 3000?

Usually no. If you're Single under 65 and your gross income is under $8,950 for 2008 (under $9,350 for 2009), then you aren't required to file. However, even if you're not required to file, you should file if income tax was withheld from your paychecks in order to receive a refund of that tax. You also should file if you're eligible for certain tax credits such as earned income.

Can dependents file taxes?

Yes. The IRS has income guidelines for determining whether dependents are required to file their own tax returns. Generally, for 2008 income, dependents are required to file if single under 65 with earned income of over $5,450 ($5,700 for 2009) or if married under 65 with earned income of over $6,800 ($7,100 for 2008). Even if your income is below the level requiring you to file, you should file if income tax was withheld from your earnings in order to receive a refund of that tax.

If you make under 12000 in Michigan can you get back all of your taxes?

Probably not. But you will NOT know the correct answer until you fill out your 1040 federal income and state income tax return correctly down to the last lines where it says taxes owed or tax refund amounts.
