How do you find out if a deceased person has a will?

I am not an attorney. Wills must go through probate court, so I think that you could check to see if your father's will has been delivered there. If you knew any of the attorneys that he might have worked with, you might check with them. Siblings, spouse at time of death, or clergy may have information.

In the UK there is National Will Register that holds the location of Wills. They dont keep the Will, but might be able to tell where it is kept. Aslo if you know the name of the solicitor that wrote the will but they have since closed down and disappeared, they try to track them down for you.

You can also register your own Will for free so your relatives know where it is when you pass away.

They helped my friend find her mums will and saved alot of hassle and upset.

Hopefully someone in the immediate family, or the deceased's attorney, knows where the will is located. If the will cannot be located, and verified, the state will view the deceased' as having died "intestate" and the estate will be divided per state law.

(in the US) it is not necessary to register or file a will with the courts or any legal agency. Unless the person who drew up the will (and is still living) wishes to inform you of its existence, there is no way yhou can learn this. If you are asking about a will of a person who is now deceased, go to your local probate court and ask. Probate (and other court records) are public documents and if the estate of the deceased is being (or has) gone through probate it should be on file with the probate court.
