Go to your county's courthouse and go to the Clerk's Office. You can get a subpoena (for usually a fee) for either a civil or criminal case. Fill it out, keep a copy, take to sheriff's dept so they can serve it on the person. You will need their verified address. There is usually a fee to serve it as well but at least it shows record that you did it and the person is more likely to show up for court. If they are served and don't show up, they can be penalized by the court.

What can you do to get your child back from a person who said he was the father and got a court order along with a restraining order and he's not on the birth certificate?

Courts do not grant parental rights, custody and restraining orders without evidence. They do not grant custody to a man who only "says" he's the father or to someone who is "presumed" to be the father. They establish paternity first. Can an opposing attorney be a witness?

Yes, they can. Typically a defense attorney will subpoena the witness, but the attorney may request that the court order the witness to remain in the court after testifying for the state. This assumes there is evidence the witness has to offer that cannot be brought out on cross examination of them for some reason. The better practice is to issue a subpoena.

Was not served a subpoena for a witness?

If someone was not served a subpoena for a witness, it means they were not formally ordered to appear in court or provide testimony. This can occur for various reasons, such as the issuing party deciding not to pursue that individual or procedural errors in the subpoena process. Without the subpoena, the individual is not legally obligated to attend the court proceedings. However, they may still voluntarily choose to testify if they wish.
