I don't believe that any such statistics are kept as a seperate category since whether they receive jail time or not, they are all lumped topgether statistically as convictions.
Besides, such a deicision is left entirely up to the individual judge hearing the case. Some are "hanging" judges and some are not. The fact that it is a felony case does not bode well, even for a first-timer.

No, it is still a felony. People must go to jail to pay for it this guy/ girl is an idiot. i was conficted of a felony domestic violence charge and it was later dismissed and dropped. i went through a year and a half of probation (suppossed to be three years, but i got off early due to "good behavior". its not hard, it just takes time.
"People" don't press charges. The State (in the form of the prosecutor's office) presses charges. If the complainant in the offense you are being charged with is currently in prison, does not mean that you he can't be a witness against you in the offense you allegedly committed against him.

Illicit drugs is a very serious offense in South Dakota. People caught in possession of two to four grams are usually given 20 years to life. If caught with more than four grams the death penalty is given.
