Judges tend to give quite a bit of weight to the reports of PO's, especially if the PO has proven to be reliable and competently trustworthy in the past. HOWEVER - that being said - all judge's are individuals and you have already VOP'd once. They may just decide to put you where you won't fall into any more temptation, or where they think you might learn your lesson.

Can an officer take a person in custody without a custody order?

CUSTODY or make an arrest? What do you mean by custody? If he is picking somebody up it requires a judges order (warrant), and for a judge to sign a warrant, the police have to provide the judge with probable cause. An officer can make take someone into custody if a probation officer reports a probation violation or if the officer witnesses the person committing the crime. If an office doesn't follow proper procedure, has to answer to the court as to why he did what he did. There are checks and balances that help prevent violations of these rules, in most cases.

What is probation compliance caseload?

When faced with a phrase, break down each word's meaning. Probation is a court ordered restriction given in lieu of (instead of) jail time or in addition to incarceration, with probation served after imprisonment, Compliance means to adhere to the rules or conditions set forth. (Example: The nurse complied with all safety requirements.) A caseload refers to a workload, consisting of "cases". A "case" refers to a file documenting contacts with an individual, whether in counseling, hospital, or probation department. So a probation compliance caseload could be rewritten as "a probation officer with X number of individuals who must report their adherence to the rules" or "a probation officer's interactions with individuals to make sure the persons adhere to the rules". Both the individual and probation officer have responsibilities in this process, but most of the responsibilities rightly falls on the individual to do.

Does there have to be a search warrant for a probation search?

If the probation officer is conducting the search then he must be there for it. Every state has its own procedures for conducting searches on their probation clients. Police generally cannot assist probation officers with their search, but probation officers can assist police with theirs. But police must still have a search warrant, while probation officers don't-- IF such search is allowed as part of the subject's condition of the probation. In practice, however, probation officers don't help police with their search because they can easily and unknowingly contaminate the evidence or crime scene. Probation officers' searches generally have a different purpose than police searches. If you're asking if the subject's probation officer must be there to conduct a search, then generally yes, they cannot substitute another probation officer for the subject's assigned PO.

Does detox really help on probation?

No

You violated your probation because you were not supposed to drink alcohol you went to an alcohol treatment for an assesment and passed it Now your probation officer wants you to call?

CALL HIM ASAP OR IT'S A VIOLATION Also, have your head examined. Doing alcohol or drugs when you are in an "on-call" testing programme is like totally self-destructive. BTDT! Of course you might have that sub-conscious desire to self-destruct, too. It sounds like you are an alcohol addict; find help buddy or you will hit the bottom again. I'm an alcoholic and mixed drug addict clean since 1995, by the way.
