How much notice does a tenant have to get rid of a pet?

If the pet is included on the lease then the landlord cannot give the tenant such an order until the lease term expires. If this is a month-to-month tenancy then the landlord has to give the tenant a 30 day notice of such before the next rent is due.

The landlord can find a tenant in breach of a lease at any time the landlord discovers what he believes is a breach of the lease agreement. That usually means a 3-5 day notice (always safe to go with the higher number) to correct or quit (end the lease and proceed to eviction). So in theory, a tenant could be given notice to have an animal removed in 3-5 days.

However, if this is not an existing term (No pets policy) of a written lease, you must create an addendum to your lease and have both the tenant & yourself agree by signing it. If it's not a term of an oral lease (most oral leases are tenancy at sufferance's (month to month)), you must give the tenant thirty days notice to a new policy. Remember, the tenant has the right to disagree with that policy and give you notice to of their intention vacate the premises after thirty days.
